Agreement

These Terms of Service are an agreement between you and Instant Locksmith TN. They govern your use of instantlocksmithtn.com, online and phone ordering, and the locksmith services we provide. By using the website or placing an order, you agree to these terms, our Service Terms, our Privacy Policy and the policies linked below. These terms include a binding arbitration agreement and a class-action waiver (see Dispute resolution).

Our services

Instant Locksmith TN is a mobile, service-area locksmith business providing automotive, residential and commercial locksmith services in Tennessee, with a primary focus on Middle Tennessee. We have no walk-in storefront; technicians come to your location. See our locksmith services and areas served. Some services — including vehicle key programming, high-security locks and safes — depend on make, model and hardware; tell us the year, make and model or describe the hardware when ordering and we'll confirm before dispatch.

Instant Locksmith TN is insured, and every technician is background-checked. Tennessee repealed its statewide locksmith licensing law in 2021 (Public Chapter 572), so there is no state locksmith license to hold, and we do not claim one.

Ordering and acceptance

You can order online at our order page (choose a service, enter your location, describe the problem, review the price and service call, pay the service call through Squarespace's checkout and submit) or by phone at (707) 653-6152. Phone orders also pay the service call up front. Submitting an order is a request for service; it is accepted when we confirm dispatch.

We may decline an order — for example, if the location is outside our service area, the job is outside what we can safely or lawfully perform, or no technician is available. If we decline or cancel for reasons on our side, the service-call deposit is refunded in full.

Eligibility and minors

Customers must be 18 or older. A customer under 18 may be served only if a parent or legal guardian is present or on the phone to confirm the situation. This does not delay an ILT Lifesaver response.

Using the website

• You may not use the website to request entry to any vehicle, home, business, safe or other property you are not authorized to access.
• You may not interfere with the website, attempt to access systems you are not authorized to use, or submit false or fraudulent orders.
• Articles and guides on this website are general information, not professional, legal or safety advice for your situation.
• Website content, including text, design and logos, belongs to Instant Locksmith TN or its licensors and may not be copied or reused commercially without permission.
• We are not responsible for the content or practices of third-party services we link to or rely on, such as Squarespace, payment apps and map providers.

Website provided “as is”

The website is provided “as is” and “as available,” without warranties of any kind to the extent permitted by law. We keep prices and service descriptions current, but if a posted price is clearly in error, we will tell you before dispatch and you may cancel for a full refund.

Pricing summary

Car lockouts start at $55 and house lockouts at $80 (standard rate); other services are quoted before dispatch. Every visit also carries a flat service call — $15 inside city limits or $25 outside — plus a mileage fee of $1.25 per mile beyond 5 miles from the city center of the nearest served city. • Orders placed between 7:00 AM and 8:00 PM on a non-holiday: standard price
• Orders placed between 8:00 PM and 7:00 AM: 1.5× standard
• Orders placed on a U.S. federal holiday: 2× standard
• Orders placed on a U.S. federal holiday between 8:00 PM and 7:00 AM: 3× standard (1.5 × 2)
• Weekends: no surcharge

The rate is set by the time the order is placed — when you submit an online order or when we take your order by phone — not by when the technician arrives or finishes. Orders placed between 8:00 PM and 7:00 AM are billed at the after-hours rate. There is no weekend surcharge; a Saturday or Sunday order is billed at the standard or after-hours rate like any other day.

Holidays means U.S. federal holidays: New Year's Day, Martin Luther King Jr. Day, Washington's Birthday (Presidents Day), Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. Holiday pricing applies to orders placed on the holiday's calendar date. When a federal holiday falls on a Saturday or Sunday, holiday pricing applies on both the calendar date and the weekday on which the holiday is observed (for example, if Independence Day falls on a Saturday, holiday pricing applies on Saturday, July 4, and on the observed Friday, July 3).

What the multiplier applies to. The after-hours and holiday multipliers apply to everything on the job — the service price, labor, parts and hardware, and job fees such as drilling, rekeying, door prep, disposal and diagnostic fees. Only two charges stay flat at any hour: the service call ($15 or $25) and the mileage fee.

Your price is confirmed before work begins. It can change only if the job turns out different from what was described — for example, a different lock, extra parts, a key broken inside the lock, high-security hardware, or a lock that must be drilled. The technician explains the change and the new price before continuing, and no additional work is done or charged without your approval. If you decline the changed price, or decline drilling, you pay only the service call.

Deposit, cancellation and refunds

The service call is your deposit. It is refunded in full if you cancel before the technician checks in as en route (you are notified at that moment), and it is non-refundable after that, except as stated in our Cancellation Policy — for example, if the technician is more than 20 minutes past the ETA we gave you. Approved refunds are issued to the original payment method within 5 business days of approval.

Payment

The service call is paid up front through Squarespace's standard checkout (Squarespace Payments) when you order online. Phone orders also pay the service call up front, before dispatch. The balance can be paid on site by card through our checkout, Apple Pay, Cash App, Venmo, Zelle or cash. Instant Locksmith TN does not see or store your full card number.

When the balance is due. For individual customers, the balance is due on receipt — when the work is complete and you receive your invoice. Business accounts may be offered net 15 terms at our discretion; all other accounts are due on receipt. Receipts and invoices are sent by email.

Authorization and our right to refuse

We only open, rekey, or make keys for vehicles, property, safes and containers that the customer is authorized to access. We do not necessarily require traditional proof of ownership or residence, such as a title or utility bill, but we verify authorization before opening anything, and you agree to cooperate with reasonable verification and to give truthful information. Verification can include photo ID, information only the owner or occupant would know, matching registration or lease details, or a call to the property manager.

Our access to investigative verification resources gives us an unusual additional capability when identity or ownership needs to be confirmed: we have a direct relationship with a licensed private-investigation agency. Information is shared with that agency only in connection with a service you have purchased and only with your consent. See how verification works.

We may refuse, stop or decline service at our discretion if authorization cannot be verified, if information you gave appears false, if we believe a request is unlawful, or if the site is unsafe. If on-site verification fails, the customer is responsible, and the service-call deposit is non-refundable. Requests to enter property a person is not authorized to access may be reported to law enforcement.

Your representations

By ordering, you represent and warrant that: (a) you are the owner of the vehicle, property, safe or container, or are otherwise legally authorized to access it and to authorize the work; (b) the information you give us, including your identity, location and description of the problem, is true and complete; (c) you are at least 18, or a parent or legal guardian will confirm the situation as described above; and (d) you will be present, or have an authorized adult present, when the technician arrives.

Response times are goals, not guarantees

Instant Locksmith TN is available 24/7/365 and generally aims to deploy within about one hour inside city limits in our core Middle Tennessee service cities when feasible. Any arrival time we give is an estimate and a goal, not a guarantee. Arrival depends on current demand, technician availability, traffic, weather, location and job complexity. We are not liable for delays outside our reasonable control.

Chargebacks and payment disputes

If you initiate a chargeback or payment dispute with your card issuer, bank, payment app or payment processor for services Instant Locksmith TN provided, you agree to repay the full amount owed for those services plus $300 as liquidated damages, and you authorize Instant Locksmith TN to collect those amounts, including by charging the payment method used for the order, through a collection agency, or in court.

The $300 amount is not a penalty. A payment dispute causes real administrative and logistical costs — staff time to gather job records, photos and communications, preparing and submitting the response to the processor, processor dispute fees, delayed and frozen funds, and follow-up collection work. Those costs vary from dispute to dispute and are difficult to determine precisely in advance, so the parties agree that $300 is a reasonable estimate of them.

This does not limit your right to dispute a charge for services we did not provide, for an amount you did not approve, or for an unauthorized or fraudulent transaction. Please contact us first at contact@instantlocksmithtn.com or (707) 653-6152; most billing problems can be resolved directly.

Warranty

Hardware that Instant Locksmith TN installs or replaces carries a 6-month installation warranty or the manufacturer's warranty, whichever is longer, starting on the date of installation. Warranty claims are limited to problems with hardware we replaced or installed; other services (for example, lockouts and openings where no hardware was installed) are not covered by a warranty. You must report a problem within the applicable warranty period by emailing contact@instantlocksmithtn.com or calling (707) 653-6152. We will inspect the hardware and, if the problem is covered, correct it.

The warranty does not cover damage from misuse, accidents, forced entry by others, tampering, weather or normal wear, or work performed by anyone else after our visit. For hardware you supplied, our installation warranty covers our installation work; defects in the product itself are a matter for its manufacturer or seller.

Limitation of liability

To the fullest extent permitted by law: (a) Instant Locksmith TN is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost business, lost wages or loss of use, arising out of or related to our services or this website; and (b) our total liability for any claim arising out of or related to a job is limited to the amount you paid for that job. If the law does not allow a particular limitation, that limitation applies to the greatest extent the law allows.

Indemnity

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Instant Locksmith TN and its owners, officers, employees, technicians and agents from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to your order, the services performed at your request, your use of this website, any information you provide (including any misrepresentation of your authority to access a vehicle, property, safe or container), or your violation of these terms or of any law. This obligation is broad, survives completion of the service and any termination of these terms, and continues permanently.

ILT Lifesaver

ILT Lifesaver provides free emergency entry when a child, a pet or an at-risk adult is trapped in a vehicle or residence and their life is in immediate danger. It is governed by the ILT Lifesaver Terms. Always call 911 first when anyone may be in danger; we are not an emergency medical, fire or police service (see the Emergency Service Disclaimer).

Governing law

These terms and any dispute arising out of or related to them, our website or our services are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules, and by the Federal Arbitration Act for the arbitration agreement below.

Dispute resolution, arbitration and class-action waiver

Talk to us first. If you have a concern about a job or a charge, contact us at contact@instantlocksmithtn.com or (707) 653-6152 and give us 30 days to try to resolve it informally.

Binding arbitration. Except for the small-claims option below, you and Instant Locksmith TN agree that any dispute, claim or controversy arising out of or relating to these terms, our website, an order or our services will be resolved by binding, individual arbitration rather than in court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and will take place in Davidson County, Tennessee, or by phone or video if the arbitrator allows. The arbitrator's award is final and may be entered as a judgment in any court with jurisdiction. There is no judge or jury in arbitration, and review of an award is limited.

Small-claims carve-out. Either party may instead bring an individual claim in small claims court (in Tennessee, General Sessions Court) if the claim qualifies there and stays there.

Class-action waiver. You and Instant Locksmith TN each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of more than one person. If this class-action waiver is found unenforceable as to a claim, that claim must be heard in court, not in arbitration.

Venue. For any matter that is not arbitrated — including small-claims matters, actions to enforce or confirm an arbitration award, and claims a court decides are not subject to arbitration — venue is exclusively in the state courts located in Davidson County, Tennessee (or the federal court for that district, where federal jurisdiction exists), and you consent to personal jurisdiction there. Lawsuits filed by Instant Locksmith TN, including actions to collect unpaid balances or chargeback amounts, may be initiated in Davidson County, Tennessee, regardless of where the service was performed.

Severability

If any part of these terms is found unenforceable, that part will be enforced to the maximum extent permitted, and the rest of these terms remain in effect. Our failure to enforce a provision is not a waiver of it.

Changes to these terms

We may update these terms from time to time. The version posted on this page when you place an order applies to that order. The “last updated” date below shows when the terms last changed.
